Terms of use

1. Who we are and what these terms cover

TennisTemple is a tennis media and community: news, live scores, results and rankings, videos, discussions, private messages, predictions and contests. It is available on the website tennistemple.com and in the TennisTemple apps for iOS and Android (together, "TennisTemple").

TennisTemple is published by TGNC SARL, a French limited liability company with a share capital of €15,000, 11 allée de la Bartavelle, 95800 Courdimanche, France, RCS Pontoise 504 914 433, VAT FR41504914433, phone +33 6 13 29 80 24 ("we"). The publication director, the hosts and the rest of our legal details are on the Legal notices page, available at the bottom of every page.

These terms apply to everyone who uses TennisTemple: visitors, members and subscribers. How we handle personal data is explained in our Privacy policy, available at the bottom of every page and in the apps' settings.

2. Accepting these terms

By using TennisTemple you accept these terms. Members accept them again when creating an account, and confirm at that moment that they are at least 15 years old. If you do not accept them, do not use TennisTemple.

3. Your account

• You must be at least 15 years old to create an account. We delete any account we learn belongs to a child under 15.
• Give accurate information, and keep your password, passkey and sign-in access to yourself. You are responsible for what is done from your account; tell us at once if you think someone else is using it.
• Your username must not impersonate another person, a player, a brand or TennisTemple, and must not be offensive.
• Do not use several accounts to get around a restriction or a ban, to influence votes, rankings or predictions, or to pretend to be several people.
• You can delete your account at any time in Settings › Delete my account. It is erased after 5 days, during which you can cancel. An account not used for 3 years is deleted, as described in the Privacy policy.

4. What you publish

You can publish posts, comments, articles, photos, videos and messages. You remain responsible for what you publish, and you confirm that you have the right to publish it.

It is forbidden to publish:

• illegal content, including content inciting hatred, violence or terrorism, child sexual abuse material, and content infringing someone else's rights;
• insults, harassment, threats, defamation, and attacks on someone's dignity, including athletes, journalists and other members;
• discriminatory content (origin, religion, sex, sexual orientation, disability or any other ground protected by law);
• pornographic or sexually explicit content, and violent or shocking content without information value;
• personal information about someone else (address, phone number, private photos…) without their consent;
• content copied from others without their permission (articles, photos, videos, live streams);
• spam, advertising and repetitive promotional links not approved by us, scams and phishing;
• false information presented as fact with the intent to mislead, and content impersonating someone else.

The licence you give us. So that we can show what you publish, you grant TGNC a non-exclusive, free licence, for the whole world, to host, reproduce, display, translate (including by automatic translation) and adapt it to the formats of our services (resizing, cropping a photo, an excerpt in a preview), and to distribute it on the TennisTemple website and apps, in our newsletters and on TennisTemple's social media accounts, with your username. This licence lasts as long as your content is online. It ends when you or we delete the content, except for articles and predictions, which stay online without your name after your account is deleted (see the Privacy policy), and for copies others have already shared. You keep your rights over your content, and we respect your moral rights.

5. Moderation

We review content to apply these terms and the law, with a moderation team and with automated tools that flag or hide content that appears to break our rules (see "Automated moderation" in the Privacy policy). When content or an account breaks these terms, we can, depending on how serious and repeated the breach is: hide or remove the content, limit the account (for example its ability to publish or send messages), suspend it, or close it permanently (ban). For serious cases (illegal content, threats, child abuse material) we act without warning and may inform the authorities.

Telling you why. When we remove your content or restrict your account, we tell you what we did and why, on which rule or law it is based, and whether an automated tool was involved, unless the law prevents it or it would help spam or fraud.

Reporting content. Anyone can report content they think is illegal or breaks these terms, with the report button on posts, comments, private messages and profiles, or by writing to contact@tennistemple.com (for anything without a report button, such as the name of a group or a prediction league). To help us act, say where the content is, why you think it is illegal or against our rules, and give your name and email address (except for reports of child sexual abuse material). We confirm receipt, review the report diligently and objectively, and tell you what we decided. Someone who repeatedly sends reports that are clearly unfounded may have their reports ignored for a while.

Challenging a decision. If you disagree with a decision we took on your content or account, or on a report you made, write to contact@tennistemple.com within 6 months, quoting the reference given in our notice. A member of our team who did not take the first decision reviews it, and we reverse it if it was wrong. You can also turn to an out-of-court dispute settlement body certified under the EU Digital Services Act, or to the courts.

Bans. A banned member may not create a new account. To enforce a ban, we keep a fingerprint of the banned account's identifiers for the duration of the ban, at most 5 years, as described in the Privacy policy.

6. The TennisTemple AI assistant and automatic translation

Some features use artificial intelligence: the assistant that answers members' questions in discussions, and the translation of articles, news and other content into the languages of the site. AI answers and translations can be wrong or incomplete. They do not replace your own judgement, and must not be relied on for any decision with consequences for you (betting, health, legal or financial matters). The number of assistant answers per day is limited, and the limit is higher for Premium subscribers.

7. Predictions, boosts, rankings and contests

• Predictions are a free game for fun. No money is staked and none can be won through predictions, and points, rankings and boosts have no monetary value: they cannot be exchanged for money, sold or transferred to another account.
• Boosts increase the points a prediction can earn. Members receive some for free, Premium subscribers receive 4 more each month, and they can also be bought (see section 8).
• Scores and rankings are calculated from match results. When a result is corrected (walkover, retirement, data error), we recalculate the points concerned. A boost used on a match that does not take place (walkover) is given back.
• Cheating (multiple accounts, automated tools, exploiting a bug) leads to the cancellation of the points concerned and may lead to the closure of the account.
• Contests are free to enter, and each one has its own rules, published with it, which say how winners are chosen and what the prizes are.

8. Premium and purchases

Premium is an optional subscription. It is not needed to use TennisTemple. It removes ads and gives faster score updates, smoother navigation in the apps, 4 extra boosts a month and more daily answers from the AI assistant. Prices are shown, including VAT, before you pay.

In the apps, Premium is sold by Apple (App Store) or Google (Google Play), weekly or yearly, and may start with a free trial. The subscription renews automatically at the end of each period unless you turn off renewal at least 24 hours before it ends, in your App Store or Google Play account settings. The store charges you, and its own rules apply to payment, cancellation and refunds: ask Apple or Google for a refund. Deleting the app or your account does not stop the store subscription.

On the website, Premium is sold through PayPal as a subscription that renews automatically and may start with a free trial; you can cancel it at any time from your Premium page, and Premium then stays active until the end of the period already paid. You can also buy credit through PayPal and use it for Premium or boosts. Credit is attached to your account; it has no value outside TennisTemple and cannot be refunded in cash, except as described below, or transferred to another account. A lifetime Premium subscription lasts as long as your account and the Premium service exist.

Right of withdrawal. If you are a consumer in the European Union, you have 14 days from a purchase made on the website to withdraw from it, without giving a reason, by writing to contact@tennistemple.com. We refund you within 14 days, through the payment method you used:

• credit: the credit you have not used, in full. When you buy credit, by ticking the box shown before payment, you ask for it to be usable at once and you acknowledge that you lose the right of withdrawal for the credit you spend (boosts are supplied immediately);
• a Premium subscription: what you paid, minus the share of Premium already supplied up to your withdrawal, since you asked, by ticking the box shown before payment, for it to start immediately. A free trial costs nothing.

For purchases made in the apps, the withdrawal right is handled by Apple or Google.

Legal guarantees. As a consumer, you benefit from the legal guarantee of conformity for digital content and services (French Consumer Code, articles L224-25-12 and following). If a paid feature does not work as described, contact us.

If we stop a paid feature for good, we refund the unused part of what you paid for it, or offer an equivalent.

9. Our content and data

Articles, photos, videos, logos, the design of the site and apps, and our databases (scores, results, rankings, statistics, player and tournament information) belong to TGNC or to their authors and partners, and are protected by intellectual property law, including the database producer's right.

You may share links to our pages, and quote short excerpts with a clear credit and a link to the source. Any other reproduction or reuse, in particular for commercial purposes, needs our written permission. It is forbidden to extract or reuse all or a substantial part of our databases, including by automated means (scraping, bots, crawlers other than search engines), or to reuse our live scores.

10. Using TennisTemple properly

Do not try to get around our security measures or access other members' accounts or data, overload our servers, use bots to create accounts, publish, vote or send messages, or use TennisTemple in a way that harms other users or TGNC.

11. Links, embedded content and advertising

TennisTemple contains links to other sites, embedded content (videos, posts from social networks) and advertising. These are provided by third parties, who are responsible for them; their own terms and privacy policies apply. Advertising on TennisTemple is identified as such.

12. Availability of the service

We work to keep TennisTemple available and its information accurate, but we cannot guarantee that it is always accessible, without errors or interruptions. Live scores and results come from data providers and can be delayed or wrong: check the official sources before relying on them, in particular for bets. We may change, suspend or stop all or part of TennisTemple; we will tell members in advance of a significant change to a paid feature.

13. Liability

As the host of members' content, we are not responsible for it until it is reported to us; we then act promptly when it is clearly illegal. Each member is responsible for what they publish and do on TennisTemple.

We are liable for damage caused by our breach of these terms, within the limits allowed by law. We are not liable for indirect damage, for damage caused by your own breach of these terms, by a third party or by force majeure, or for losses related to bets placed using information found on TennisTemple. Nothing in these terms limits the rights that consumer law gives you, or our liability where the law does not allow it to be limited (gross negligence, wilful misconduct, personal injury).

14. Changes to these terms

We may update these terms, for example when the services or the law change. The date at the top shows the latest version. For a significant change, we inform members by email or by a notice on the site or in the apps at least 30 days before it applies, except when the change is required by law or to protect users. If you do not accept the new terms, you can delete your account before they apply; continuing to use TennisTemple afterwards means you accept them.

15. Law, complaints and disputes

These terms are governed by French law. If you are a consumer living in another country, you also keep the protection of the mandatory rules of the law of your country.

In case of a problem, contact us first at contact@tennistemple.com; we try to find a solution with you.

Failing an amicable solution, disputes go to the competent French courts. If you are a consumer, you can also go to the court of the place where you live.

16. General

If a clause of these terms is held invalid, the others still apply. Not enforcing a clause at a given time does not mean we give up the right to enforce it later. These terms are written in French and translated into the languages of the site; in case of a difference, the French version prevails, unless the law of your country provides otherwise.
